Clayton Concrete and the Right-of-Way

Clayton has written rules for concrete in the right-of-way, and the concrete contractors in Clayton that homeowners hire have to follow them. The City of Clayton's Chapter 904 sets requirements for driveways, curb approaches and sidewalks in the right-of-way. Installing or repairing any of them takes a permit, a city inspector checks the job, and a contractor doing the work must post a cash bond or security. An owner who does all the work personally skips the bond but still needs the permit and inspection.

Joints where new meets old

One detail in Clayton's rules stands out: vinyl expansion joint material is required wherever new concrete meets old, as shown in the Clayton Standard Drawings. That matters on approach and walk replacements, where new concrete butts against an existing curb or the neighbor's sidewalk. Without a proper joint, the two pieces move against each other and crack. We set the joint material before we pour and keep it straight and flush.

The city also notes that an asphalt driveway still needs a right-of-way permit for the apron where it meets the street, even though resurfacing the rest of an asphalt drive needs no permit.

From Salem to Clayton

Clayton was platted in 1816 under the name Salem. It struggled after the National Road bypassed it, then became a stop on the Dayton Northern Traction Line in 1906. In 1998 it became a city by merging with the rest of Randolph Township. The census shows the jump: 713 residents in 1990, 13,347 in 2000 and 13,310 in 2020. Clayton covers about 18.6 square miles, and 82 percent of its homes are owner-occupied.

Big lots, long drives

With that much land for its population, Clayton has more space per home than most suburbs. Many properties have long driveways, side-load garages or room for a large patio. Long driveways need joints laid out along their length and attention to drainage at low spots. Side-load garages need a turning pad thick enough for repeated tight turns. We plan both before we quote, and we check truck access on larger lots.

Clayton Questions

Do I need a permit to replace my driveway apron in Clayton?

Yes. Installing or repairing a driveway, curb or sidewalk in the right-of-way requires a city permit and inspection, and contractors must post a bond.

I have an asphalt driveway. Do I still need a permit?

Only for the apron where it meets the street. The city says resurfacing the rest of an asphalt drive needs no permit or inspection.

Why does Clayton require expansion joints?

New and old concrete move differently. The city requires vinyl expansion material at those seams so the slabs do not crack each other.
